Torrent's zero-value contract change does not resolve the DANA workfront
CHJ fixes the Torrent contract's setting-out check on 18 September 2023 and the start of its 30-month execution clock on 19 September 2023. Its 2025 ledger then records EUR 997,242.85 certified against modification 1 and EUR 854,404.65 against emergency lot 1, while PLACSP's 10 August 2026 modification record adds zero euros and zero months. These facts can coexist: annual certification shows recorded expenditure, not a price increase, and the post-DANA flood-defence and setback works remain a separate package interface.
Modification 1 changes neither price nor duration
The 10 August 2026 PLACSP record gives modification 1's zero-euro and zero-month increments and a 30-month final duration. MITECO publishes the signed contract, UTE, values, supervision and approved treatment design. CHJ's 2025 Technical Directorate report records the 18 September 2023 setting-out check, 19 September site start, post-DANA scope description, EUR 6.0 million emergency estimate and annual certified amounts. Its 08.346.683/2121 heading and 'before 08.346.683/2111' certification reference are retained as an official file-number discrepancy. CHJ's current register supplies only the execution classification. The emergency contractor remains unidentified, and the emergency package has no stated transfer into the main UTE contract.
Flood resilience has its own contract ledger
Contract 08.346-0683/2111 fixes a named UTE and a EUR 20.794 million excluding-VAT baseline for an 18,000 m3/day plant upgrade with aerobic treatment, AnMBR, tertiary treatment, sludge works and agricultural reuse. The 2024 flood damaged the active works and forced a roughly 50-metre setback from the Poyo channel. CHJ says emergency lot 1 includes demolition and reconstruction of displaced elements, a replacement reclaimed-water tank, automated gates, a perimeter flood wall, raised ground, a new non-floodable access road, utility diversions and waste management. That scope makes the unresolved responsibility map commercially material to the civil, process, electrical and continuity workfronts.
Evidence conclusion
Current execution needs a physical baseline and two package maps
The site-start date is now evidenced, but the post-DANA approved baseline is not. PLACSP gives a EUR 0 price increment, 0-month duration increment and 30-month final duration; CHJ gives 2025 certified amounts, not variation values or final cost. Emergency lot 1 remains outside the main UTE award. CHJ's EUR 6.0 million estimate and MITECO's approximately EUR 6.2 million figure are dated source snapshots, and the EUR 0.30 difference between PLACSP's formalised and final tax-exclusive figures remains a separate data-quality issue.
